Using Road to the Election
These Terms govern your use of Road to the Election, operated by BG Media, LLC. By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website. Our Privacy Notice describes our collection, storage and use of information and is incorporated into these Terms.
The website provides a commercial survey and may display advertising and marketing offers. It is not an election authority, voter-registration service or scientific poll. Results reflect participants, not a representative sample of the public. Participation does not cast a vote in an election. Registration and marketing-partner delivery are not currently live.
Changes and availability
We may modify or discontinue website content, sponsored content or services at our discretion. We may update these Terms by posting changes here. Review them before using the website.
Intellectual property and personal-use license
Website text, graphics, trademarks, logos, code and other content are owned or licensed by BG Media or their respective owners and protected by applicable intellectual property law. We grant a limited license for personal use of website content. This does not permit resale, commercial exploitation, copying or distributing protected content, or data mining without our prior written permission. Third-party marks remain the property of their owners.
Restrictions on use
- Do not misuse the website, interfere with its operation or upload malicious code.
- Do not remove proprietary notices, reverse engineer protected software, scrape or index the site using automated tools without permission, or commercially exploit its content.
- Do not violate applicable law or collect or store information about other people through the website.
Copyright concerns
If you believe content infringes your copyright, contact us using the details below. Include identification of the copyrighted work and where the disputed material appears, your contact information, a good-faith statement that the use is unauthorized, a statement under penalty of perjury that your notice is accurate and you are authorized to act, and your physical or electronic signature.
Advertisements and third-party links
Advertisements and external links do not imply our endorsement. We do not control third-party websites, products or services and are not responsible for their content or practices. Review their own terms and privacy notices. These Terms are not consent to marketing calls, texts or emails.
Disclaimer and limitation of liability
The website and its content are provided ‘as is’ and ‘as available’, at your own risk. To the extent permitted by law, we disclaim express and implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant accuracy, completeness, uninterrupted availability, security or freedom from errors or harmful components.
To the extent permitted by law, BG Media and its affiliates, personnel and representatives are not liable for indirect, incidental, special, punitive or consequential damages arising from use of or inability to use the website. Our total maximum liability is limited to one hundred US dollars ($100). These limitations do not exclude rights or liabilities that applicable law does not permit to be excluded.
Disputes, arbitration and class-action waiver
To the extent permitted by law, disputes relating to this website, these Terms or the collection or use of information are submitted to confidential binding arbitration under American Arbitration Association rules in the federal judicial district where you reside, except claims involving violation or threatened violation of our intellectual property rights. Before seeking arbitration, send a written Notice of Dispute to Legal Counsel through the contact details below, describing the dispute and requested relief. If we cannot resolve it within 30 days, either party may commence arbitration.
To the extent permitted by law, arbitration proceeds individually and may not be consolidated with another party's claim or conducted as a class or representative proceeding. You waive participation as a class representative or class member concerning such disputes. An arbitrator's award may be entered in a court of competent jurisdiction. For claims of $10,000 or less, you may choose document-only, telephone or an agreed in-person hearing. At your request we reimburse your arbitration filing fee unless the claim exceeds $10,000, in which case AAA rules govern fees. A frivolous or improper claim may require reimbursement of fees as permitted by AAA rules and applicable law.
Governing law and general terms
The laws of the State of New York, without regard to conflict-of-law principles, govern these Terms. No agency, partnership, joint venture or employment relationship is created. These Terms and the incorporated Privacy Notice constitute the agreement concerning use of this website. Failure to enforce a provision is not a waiver. An invalid provision is limited or removed to the minimum necessary so the remaining Terms remain effective. You may not assign these Terms without our prior written consent.
